1)      By entering into a Sale and Purchase Agreement for a home that is eligible for this promotion, you (as purchaser) are deemed to have accepted the following terms and conditions.

2)      Subject to and in accordance with these terms and conditions, this promotional offer is open to all Fletcher Living customers who have signed a legally binding Sale and Purchase Agreement for the purchase of a Fletcher Living home at one of our locations in Auckland, on these terms and conditions and during the promotion period referred to in clause 3 below. However, homes that fall into the following categories are excluded from and not eligible for this promotion:

a)     KiwiBuild homes;

b)     Homes located in Canterbury; and

c)     any pre-sale agreement for the sale and purchase of a new home off the plans where the settlement date is targeted by Fletcher Living for occurring after 27 June 2024 will not be eligible for this promotion.

3)      To qualify for the offer described in clause 4 below you must have signed and entered into a legally binding Sale and Purchase Agreement to purchase a Fletcher Living home between 23 February 2024 and 5 May 2024 (inclusive), with settlement to occur no later than 27 June 2024 (save where there are delays which result in settlement occurring after 27 June 2024 which are not due to any act, omission or other default by you under the Sale and Purchase Agreement).

4)      If you qualify under these terms and conditions you are eligible to receive $10,000 by way of 12 automatic monthly payments to be processed and commence during the first 10 working days of the month following the date of processing.

5)      For clarity, the total payment consists of 12 equal monthly automatic payments for one calendar year; each monthly payment being $833.33 (including GST where applicable). Customers must complete an automatic payment form to confirm their bank account details, and supply a proof of account document in order for Fletcher Living to set up the monthly automatic payments. Payments will be made during the first 10 working days of each calendar month and may take up to 5 working days to show in the nominated account.  Automatic payment setup forms for sales that satisfy the conditions set out in these terms and conditions will be processed up until the 25th of each month for payment during the first 10 working days of the following month, any automatic payments processed after this date will be processed during the next following month, for payment the month following.

6)      Only one promotional offer per signed Sale and Purchase agreement for an individual home is permitted. You will be eligible to start receiving the payments once settlement has been completed, subject to and in accordance with these terms and conditions. If you fail to settle the Sale and Purchase Agreement, Fletcher Living reserves the right to retain the full value of the deposit you have paid pursuant to the terms of the Sale and Purchase Agreement.

7)      Fletcher Living’s decision in relation to any aspect of the promotion is final and no correspondence will be entered into.

8)      Fletcher Living reserves the right to vary any of the terms or conditions applying to this promotion or to modify, extend, terminate, suspend or reschedule this promotion.

9)      Unless Fletcher Living determines otherwise, this promotion is not valid in conjunction with any other promotion that Fletcher Living may be running concurrently.

10)    To the maximum extent permitted by law, Fletcher Residential Limited, trading as Fletcher Living, and its related companies, employees and agents, will not be liable for any loss, damage, personal injury or cost (including but not limited to your legal and tax obligations and liabilities, loss of profits, direct loss, indirect or consequential loss) suffered by any person arising directly or indirectly out of or in connection with this promotion or accepting the promotional offer.

11)    Any tax obligations arising in regard to receipt of the monthly payment are the entire responsibility of the purchaser. Fletcher Living makes no representation as to the tax liability of the purchaser participating in this promotion and accepting receipt of the payments. The purchaser is responsible for any taxes and fees that may be levied or required to be paid by any law or government taxing authority in connection with this promotion, including the purchaser’s receipt of the monthly payments. No tax invoice will be issued in respect of any of the payments made.

12)    All personal information collected as a result of this promotion will be stored by Fletcher Living in accordance with the Privacy Act 2020. Fletcher Living may use your personal information to conduct the promotion and for its own future promotional and publicity purposes. 13)    The Promoter is Fletcher Residential Limited trading as Fletcher Living.
